L’histoire ci-dessous est relatée par le comité de soutien aux sans-papiers 68.
« Le Tribunal Correctionnel de Mulhouse a condamné Mme Sona CELEBI à 1 mois de prison avec sursis et 5 ans de mise à l’épreuve, pour « avoir facilité, par aide directe ou indirecte, le séjour irrégulier sur le territoire national » et pour « travail dissimulé » de M. Mehmet COMÜT, un militant menacé de mort dans son pays.
Malgré la brillante défense de Me CHAMY qui a démontré qu’aucun des deux délits n’était constitué, que l’infraction au droit du travail n’avait pas été prouvée à défaut de contrat de travail et de salaire, que la Préfecture elle-même demandait aux étrangers réfugiés en procédure de demande d’asile de se faire héberger par des personnes privées, étant incapable de loger ceux-ci malgré ses obligations légales, que Mehmet COMÜT et Mme CELEBI avaient respecté exactement ces prescriptions en fournissant une attestation d’hébergement accompagnée d’une preuve de domiciliation à la Préfecture, lors du dépôt de la demande d’asile à l’OFPRA, les Juges ont décidé que les deux infractions étaient constituées.
Depuis M. COMÜT a obtenu un titre de séjour provisoire, domicilié chez la famille CELEBI, ce qui montre bien que les services préfectoraux ne le considéraient nullement en situation irrégulière du point de vue de son hébergement.
Le juge a suivi le réquisitoire de madame la substitut pour qui la solidarité et le bénévolat n’existent pas et cachent toujours une prestation rémunérée non déclarée et une exploitation des personnes redevables de la solidarité dont elles bénéficient.
C’est bien la solidarité qui a été jugée et condamnée alors que le président du Tribunal de Grande Instance avait promis à la délégation reçue en mars 2009, à l’occasion de la journée nationale contre le délit de solidarité, que ce dernier n’existerait jamais à Mulhouse. »
« Le délit de solidarité n’existe pas », ne cesse de répéter le ministre de l’Immigration Eric Besson. Or ce cas n’est pas isolé. Au moment ou notre ministre « invite » la population au débat sur l’identité nationale, le gouvernement donne une drôle d’image de la France, une image d’une France sombre. Afin de dire que ce jugement ne correspond pas aux fondamentaux de la République, ne correspond pas à ce que nous pensons de la France, il est important de prendre la parole tant sur le site officiel même s’il ne s’agit que d’un simulacre de débat que sur des sites alternatifs.
